Terms and Conditions
These Terms and Conditions (“Agreement”) govern the use of accommodation services provided by Ohayō Siargao (“we”, “us”, “our”), a small lodging facility located in General Luna, Siargao, Philippines. By booking with us, the guest (“you”, “your”) agrees to the terms below.
1. Reservation and Payment
- The total stay fee must be paid in full to confirm the reservation and it is non-refundable.
- All rates are final and fixed upon booking confirmation. Any room upgrade/change will follow the current rate of the new room.
- Guests must present a valid government-issued ID upon check-in, as required by Philippine laws and regulations for accommodation establishments.
2. Check-In and Check-Out
- Check-in: 3:00 PM | Check-out: 11:00 AM.
- Early check-in or late checkout is subject to availability and will incur a fee equal to half the daily room rate.
- We reserve the right to refuse early check-in or extended stay due to occupancy limitations.
3. No-Show and Cancellation
- Rooms are held until 12:00 midnight on the arrival date. Failure to arrive or inform us by then will result in a no-show, and your reservation and deposit will be forfeited.
- All deposits are non-refundable regardless of reason for cancellation.
4. Security Deposit
- A ₱2,000 refundable security deposit is required upon check-in.
- It covers damages, excessive cleaning, lost items, late checkout, last-minute transport cancellations, and any other significant violation of these terms and conditions that results in additional costs or damages to Ohayō Siargao.
- The deposit will not be refunded in cases including but not limited to:
- Smoking on premises (verified by CCTV)
- Noise complaints
- Eviction for violating house rules
- Lost keys or excessive mess (e.g. bodily fluids, food waste)
5. House Rules
- No smoking anywhere on the premises.
- Noise must be kept to a minimum at all times. Loud music, shouting, or disruptive behavior may result in immediate eviction without refund.
- Only registered guests are allowed on the premises. Visitors are not permitted inside guest rooms.
- Fridge and shared spaces will be cleaned weekly. Unclaimed items will be disposed of.
- Use of the shared kitchen is limited to dining and kettle use. Cooking is no longer allowed.
- Lost key replacement fee: ₱2,000.
- Damaged or stained linens: Replacement fees apply (₱2,000 minimum).
- Alcohol is permitted, but drinking must be done responsibly and without disturbing others.
6. Guest Responsibilities
- While Ohayō Siargao implements security measures such as CCTV and night patrols, guests are ultimately responsible for securing their personal belongings. Ohayō Siargao shall not be liable for any loss or theft of personal items unless such loss is proven to be a direct result of our gross negligence or willful misconduct.
- Guests are expected to carry their own bags and respect the physical boundaries of staff.
- Please help conserve resources by turning off lights and appliances when not in use.
- Environmental cleanliness is observed — indoor slippers must be worn inside.
7. Safety and Security
- The premises are monitored by CCTV in public areas for security purposes.
- We maintain night staff patrols for guest safety, but we are not liable for losses due to theft or burglary.
- Always lock doors and windows when leaving your room or sleeping.
8. Limitation of Liability
- Ohayō Siargao exercises reasonable care and diligence in providing a safe environment. However, we shall not be liable for accidents, injuries, or losses sustained during a guest's stay that are not attributable to our gross negligence or willful misconduct.
- Guests are responsible for securing their own belongings and travel insurance.
- Ohayō Siargao shall not be held liable for injuries, accidents, delays, loss of personal property, natural disasters, acts of God, or force majeure events during the guest’s stay.
9. Right to Refuse Service / Eviction Policy
- Ohayō Siargao reserves the right to refuse service or terminate the stay of any guest who fails to comply with house rules, engages in illegal activities, or poses a safety risk.
- In such cases, no refunds will be given.
10. Compliance with Law
- Guests agree to abide by Philippine laws and local ordinances.
- Any violation of these Terms or applicable law may result in cancellation of stay and forfeiture of any payments made.
11. Data Privacy
- Ohayō Siargao collects and processes personal data (e.g., names, contact details, IDs) solely for the purpose of confirming reservations and complying with local government regulations.
- All data is handled securely and will not be shared with third parties, except as required by law or with guest consent, in accordance with the Data Privacy Act of 2012 (RA 10173).
12. Dispute Resolution
- Any disputes arising from a stay at Ohayō Siargao shall first be resolved amicably.
- If unresolved, the parties agree to submit to the jurisdiction of the proper courts of Surigao del Norte, Philippines.
13. Severability
- If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
14. Amendments & Updates
- Ohayō Siargao reserves the right to modify these Terms and Conditions. The updated terms will be posted on our website and will apply to all future bookings.
